I have looked everywhere and i can't see Jack Dorsey's name anywhere. James is suing Twitter, the legal fiction.
Not disagreeing about the legal fiction part... But was Jack Dorsey the one who cancelled O'Keefe's service or was it another (wo)man? Can't sue Jack if he didn't do it.
I think the important precedent here needs to be regarding if Twitter is a public accommodation. If it's not, there is no grounds for suing.
Given the government funding, it should be considered a public accommodation.
Ok Leni, Imagine James calls the defendant to the stand to testify. Who will stand up?
Companies are legal persons. That's how the system works. You can say that's preposterous, fair enough, but if you want to use the legal system then that's just the way it is. You can win big settlements from companies. If you sue a person directly you stand to get less - so suing the company seems spot on to me?
I think therein lies the problem. The right thing to do for the sake of all of our futures is to take the lesser settlement and target real people, instead of living/not living in the fictional, legal realm. Constantly presenting to the fictional realm is what keeps it going. Ignoring it and refusing to participate in it is what's needed to make it go away.
Fair enough, if that is what you believe. I don't believe that however. I think James made the right call and I hope he wins a big settlement.
I am not a supporter of "sovereign citizen" stuff. I see it as a dead end and disempowering. I have no problem with "legal fictions". All legal language (including the "freeman" stuff) is a fiction.
In fact all language is a fiction. We are fundamentally just primates who grunt at each other.
If you want to be real and really dislike all these "fictions", go back to the trees where we came from 3 million years ago.
No offence intended, just calling it as I see it.
I'd happily do that... Except there will be a legal fiction come along with its big machines telling me they are going to destroy my habitat and there's nothing I can do about it except die. There's no morality in that.
Haha, but Bill Gates has your back. Once the pesky humans are eliminated it will a good time to be a wild animal.
Winston, you have no idea about the situation we are in. Sovereign Citizen is a oxymoron. You can't be sovereign and slave in the same time. The word '' person '' indicates corporate entity. Term '' legal '' applies to the corporations and term '' lawful '' applies to a man/woman. There are 3 words missing from legal vocabulary - Man, Woman and lawful. Also all courts run under civil procedure - civil, as Roman civil law in maritime jurisdiction. This doesn't apply to a man/woman flesh and blood. I suggest you study upper case writing which is called DOG LATIN or GLOSSA, and why it's not English Language. Over few years i disqualified many presentments written in DOG LATIN. Gramma it's not a trivial thing.
Thinking about this more, I do have an issue with Legal fictions. They are created for one purpose in mind, to protect the business/corporate owner/CEO from being sued. Why do they need protecting if they are not doing the wrong thing?
This system actually encourages (and "legally" requires) corporations to do the wrong thing if it means profits are first.
I see no reason why issues should not be resolved (wo)man to (wo)man, no legal fictions required.
